Real Estate Saints Service Disclaimer & Limitation of Liability

General disclaimer (applies to all services):
Real Estate Saints (“we,” “us,” “our”) provides non-licensed, non-brokerage support services to real estate professionals. We are not a real estate brokerage, property management company, security service, or legal advisor, and we do not provide legal, financial, or real estate advice.

By booking services, you (“Client”) agree that services are performed at your direction and often involve third-party property conditions, weather, public interaction, and other variables outside our control. While we use reasonable care, results are not guaranteed, and outcomes may vary.

Not responsible for third-party actions & uncontrollable conditions:
We are not responsible for loss, damage, delay, or failure caused by or related to:

  • Theft, vandalism, tampering, or actions of third parties (public, neighbors, other agents, vendors, HOA, etc.)

  • Weather, wind, rain, heat, dust, wildlife, road closures, traffic, or unsafe conditions

  • Property access issues, incorrect addresses, inaccurate instructions, or missing/defective materials

Client responsibilities:
Client agrees to:

  • Provide accurate instructions, addresses, time windows, gate codes, and contact info

  • Confirm permission/authorization for any access, placement, delivery, or posting (including HOA/municipal rules)

  • Supply materials in usable condition unless we are specifically hired to procure them

  • Ensure the property is reasonably safe (pets secured, hazards disclosed, legal access provided)

Photos & verification:
When appropriate, we may take before/after photos for proof of completion. Photos are for documentation only and do not guarantee continued condition after service is completed.

Limitation of liability:
To the maximum extent permitted by law, Client agrees that Real Estate Saints’ total liability for any claim is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages (including lost commissions, lost sales, reputational harm, or missed opportunities).

Indemnification:
Client agrees to indemnify and hold Real Estate Saints harmless from claims arising out of Client’s instructions, Client-provided materials, lack of authorization, or violations of HOA/municipal/property rules.

Service-Specific Disclaimers

Open House Sign Setup / Take-Down (up to 10 signs)

  • Signs may be stolen, damaged, knocked over, removed by others, or affected by weather/wind after placement.

  • We are not responsible for code/ordinance enforcement, HOA restrictions, or sign removal by municipalities/HOAs.

  • Client is responsible for ensuring signage placement is permitted and compliant.

Lockbox Pickup / Drop-Off

  • We handle lockboxes as a courier service only, based on Client instructions.

  • We are not responsible for lockbox malfunction, missing keys, incorrect codes, or access issues.

  • Once delivered/picked up, we are not responsible for theft, tampering, or unauthorized access resulting from lockbox placement or property conditions.

Flyer Box Refill / Flyer Delivery

  • Flyers may be removed, damaged by weather, or taken in bulk by the public.

  • We are not responsible for print defects, outdated content, incorrect property details, or compliance requirements (fair housing, disclosures, etc.) in Client-supplied materials.

  • We do not guarantee lead volume, inquiries, or buyer turnout.

Door Hangers / “Knock on Doors”

  • Public interaction involves unpredictable behavior. Client accepts the risk of negative reactions, complaints, confrontations, or refusal of materials.

  • We will not trespass, force interaction, enter homes, or ignore posted “No Soliciting/No Trespassing” notices.

  • We are not responsible for neighborhood/HOA rules, and we do not guarantee leads or appointments.

For Sale / Directional Sign Placement

  • Signs may be stolen, damaged, moved, removed, or weather-impacted after placement.

  • Client is responsible for verifying placement legality and receiving any needed approvals.

General Errands (non-hazardous)

  • Errands depend on third parties (stores, vendors, offices) and may be delayed by hours, stock availability, closures, or wait times.

  • We do not transport cash, controlled substances, firearms, hazardous materials, or anything illegal or restricted.

  • We are not responsible for third-party product defects or vendor mistakes.

Marketing Support (flyers, basic design coordination, social posting support)

  • We do not guarantee performance results (reach, engagement, leads, conversions).

  • Client is responsible for final approval of names, phone numbers, addresses, pricing, compliance language, and any claims made in marketing content.

Checkout pages / invoices

Client understands Real Estate Saints cannot control theft, vandalism, weather, public interaction, or rule enforcement and agrees liability is limited to the amount paid for the service.
